TERMS AND CONDITIONS

Welcome to Fit Mama! By using our services, you agree to comply with these terms and conditions, which apply to all our services, including Group Training, PT, and Semi-PT sessions.

Group Training Policy

  • Ongoing Membership:
    Once you start a school term, you commit to paying for the entire term, even if you choose to leave early. This is a term-based commitment, and your subscription will continue weekly.

  • Renewal and Cancellation:
    Your membership will automatically renew for the next term unless you provide two weeks’ notice of cancellation via email to hello@fitmama.com.au. If notice is not given, your membership will roll over into the next term. Upon cancellation, your membership remains active until the end of the current term.

  • Dress Code:
    Please wear suitable attire and footwear, and bring a towel, water bottle, and any necessary aids (e.g., asthma puffers, sunscreen).

  • Session Cancellations:
    Please cancel at least 24 hours in advance if you need to reschedule. Late cancellations will result in forfeiting the session, as per our policy.

Terms of Payment

  • Subscriptions:
    Payments for term-based subscriptions are due weekly through Newie.

  • Casual Sessions:
    Paid through Acuity booking system and payment is required upfront at the time of booking for casual sessions.

Refund and Cancellation Policy:

  • Missed Sessions:
    Sessions not cancelled within 24 hours will be forfeited and are not eligible for a make up class.

  • Class Cancellations:
    If we need to cancel or postpone a session, you can redeem a make-up session within 14 days.

Fit Mama’s Rights:

  • Session Adjustments:
    We reserve the right to cancel or postpone a session. Make-up sessions will be provided and must be used within 14 days.

PT & Semi PT Policy

  • Commitment and Payment:
    Personal Training requires a minimum 4-week commitment, with weekly payments processed through our payment system, Newie.

  • All bookings are managed through the Acuity scheduling system.

  • Cancellation Policy:
    A minimum of two weeks’ notice via email to hello@fitmama.com.au is required to cancel your Personal Training commitment.

  • No-shows will forfeit their session.

  • Cancellations made less than 24 hours before the session will result in the session being forfeited.

  • If you cancel with more than 24 hours’ notice, you may reschedule your session within 10 days, subject to availability.

Fitness to Participate:

  • Your Responsibility:
    It is your responsibility to ensure that you are physically and medically fit to join our programs. Please notify us in writing of any changes to your fitness condition.

Medical Treatment:

  • Emergency Care:
    You consent to us administering or obtaining medical assistance during sessions if needed and agree to cover any costs incurred.

Photographs and Right to Use:

  • Promotional Use:
    Photos may be taken during sessions and used for promotional purposes without compensation. These remain the property of Fit Mama.

Liability:

  • Risk Acknowledgement:
    You acknowledge that participation is at your own risk. Fit Mama and its trainers are not liable for personal injury or property loss.

Privacy and Data Protection:

  • Your Privacy:
    We handle your personal information according to applicable privacy laws. Your data will not be shared without your consent unless required by law.

Jurisdiction:
These terms are governed by the laws of Western Australia. Any legal action related to our services will take place in Western Australia.

Modification of Terms:

  • Changes to Terms:
    We reserve the right to modify these terms at any time. You will be notified of significant changes, and continued use of our services constitutes acceptance of these changes.

Indemnity:

  • Hold Harmless:
    Members agree to indemnify Fit Mama and its affiliates against any claims arising from their participation in the programs.

Disclaimers:

  • Medical Disclaimer:
    Seek clearance from your doctor and a women’s health physiotherapist before starting our program, especially if you are postpartum.

  • General Disclaimer:
    Fitness sessions carry risks. If you are less than 6 weeks postpartum, consult your doctor before participating. You join at your own risk. Fit Mama is not liable for injuries or health concerns.

  • Children’s Safety Disclaimer:
    Children are welcome, but they must not touch or use any fitness equipment. Please supervise your children at all times. Fit Mama is not responsible for any accidents or injuries to children.
